If you need further proof the U.S. and Israel do not want to actually take Hamas to trial, it's the veto against Palestinian statehood. If Palestine were to become a state then its governing body can be taken to trial, including for that genocide charge they constantly accuse Hamas of. They don't care though and they never did.

Also I know someone's gonna be nitpicky. I'm here to tell you to shut the fuck up. If Palestine receives statehood recognition at the United Nations level, which is the vote I'm talking about, then it will or can become a signatory of the ICC and ICJ and the current Hamas administration can be taken to court for their actions. But again, that is not the U.S.' goal.
